Your privacy, your policy – a call for Wikimedia community input

Privacy policies serve a central role in protecting user rights. These public, binding commitments serve to protect users through transparency and openness. While the current Wikimedia Foundation policy works to that end, it has been in place since 2008. In that time, our peers at Linux, Creative Commons, Mozilla, the Electronic Frontier Foundation, and StackExchange have released policies that reflect the technological and social climate of today’s Web. It is time for us to do the same.
On June 18, we asked for community input on our current Privacy Policy. The initial month-long consultation period provided valuable and insightful comments from all over the globe, covering a range of topics important to users and, in turn, to the Wikimedia projects. This feedback helped us create a new draft Privacy Policy, which reflects the thoughts of the community, as well as the Wikimedia Foundation’s tech and legal teams.
But our draft Privacy Policy is just that — a draft, in need of further community comment. We encourage participation in the discussion by anyone who is interested, and we invite comment on any and every aspect of the draft. This discussion will be open for four months, ending on 15 January 2014. This policy belongs to all of us, so it is only complete when we have heard from the most important voices in the Wikimedia movement: the global community that makes the Wikimedia projects what they are. You raised over 120 issues on our proposed Terms of Use, and, as a result, the Terms of Use that now govern the Wikimedia projects reflect many of the ideas and suggestions you raised. We look forward to equally vigorous participation in this Privacy Policy draft.
When creating the draft, we were motivated by the following principles:

  • Write in a clear and straightforward manner. We strove to write this draft in simple, unambiguous language that anyone can understand. Privacy policies, after all, are for users, not lawyers.
  • Never ask for or require contact information. We do not ask for your name, email or street address, telephone number, or similar information in order to contribute to or use the Wikimedia projects. Contributions can be made anonymously or with an account, and we require only a non-identifying username and password to create a standard account.
  • Restrict the amount of data collected. We believe the best way to protect user information is to keep it with the user. For this reason, we collect less information than other major websites.
  • Use your information to make the site better for you. We only collect information to understand how you use the sites, and how to make them better for you. Our engineering teams make use of user data to create better websites and deliver you more relevant information.
  • Never sell your information. We will never, ever sell your information. The world should benefit from your knowledge, but no one should profit from your data.
  • Help protect your information. We take precautions to protect the information we do have. We use technological and physical measures to help protect user data from unwanted exposure. When appropriate, we use legal measures to fight requests to disclose user data.
  • Hold information only as long as necessary. We protect users both by collecting limited information, and by holding that information only as long as necessary. We keep the information that we receive for only the duration that it meets our internal needs and obligations under the law.

The Privacy Policy is not our only commitment to user privacy. Today, we have also released a draft of the proposed Access to Nonpublic Information Policy. This policy draft sets the standards for how community members with access to nonpublic information can (and can’t) use the data they are given. As with the Privacy Policy, we seek your feedback on this document, so it will best reflect community values in this context.
In the coming months, we will also be releasing Data Retention Guidelines, a Transparency Report, and Requests for User Information Procedure and Guidelines. The Data Retention Guidelines, which address many of the most prominent concerns we heard during the initial consultation period, will explain our data collection and retention practices under the new Privacy Policy in greater detail. The Transparency Report will include data concerning the number of requests for user information we receive, where they come from, and how often we comply.  It will also include information about the requests we receive asking us to remove or alter content on the Wikimedia projects.

It is important to us that we hear what you think. Please, review the draft Privacy and Access to Nonpublic Information Policies, and leave any questions or concerns on their respective discussion pages. Quite simply, we want to know how we can improve these documents. We will be reading your comments and, as with the terms of use, we will incorporate appropriate changes in response to this feedback. We will be making these changes directly on the wiki, so you can see how the policies evolve over the course of the community input period and as a result of your suggestions. When the comment period has closed and we have completed reviewing and incorporating your recommendations, we will present the policies to the Wikimedia Foundation Board of Trustees for review.
Again, we anticipate closing the comment period on 15 January 2014. We have provided translations of the Privacy Policy and Access to Nonpublic Information Policy drafts in Arabic, French, German, Japanese, and Spanish. We would be grateful to the community for assistance in improving these translations, translating these drafts into more languages, and translating the feedback given by others throughout the course of this consultation period. We deeply value international participation, and, if more time is needed to allow for translations or comments, we will take that into consideration when closing the comment period.
These drafts were the collaborative effort of the Wikimedia community externally, and many Wikimedia Foundation departments internally. Many thanks to those departments; without their spectacular effort, these documents could not have been possible.

Tu privacidad, tu política: una petición de aportación a la comunidad
Las políticas de privacidad juegan un papel primordial en la protección de los derechos de los usuarios. Estos compromisos obligatorios y públicos sirven para proteger a los usuarios a través de la transparencia y la veracidad. La actual política de la Fundación Wikimedia, que entró en vigor en 2008, trabaja para alcanzar este fin. Datenschutzrichtlinien kommt eine zentrale Rolle beim Schutz von Nutzerrechten zu. Diese öffentlichen, verbindlichen Selbstverpflichtungen dienen dem Schutz der Nutzer durch Transparenz und Offenheit. Die aktuelle Richtlinie der Wikimedia Foundation, die bereits seit 2008 besteht, verfolgt diesen Zweck. In diesem Zeitraum haben unsere Konkurrenten bei Linux, Creative Commons, Mozilla, der Electronic Frontier Foundation und StackExchange Richtlinien herausgegeben, die das technische und soziale Klima des heutigen Internets widerspiegeln. Jetzt ist es an der Zeit, dass auch wir dies tun.
Am 18. Juni haben wir um Kommentare aus der Community zu unserer aktuellen Datenschutzrichtlinie gebeten. Der anfängliche Beratungszeitraum von einem Monat lieferte wertvolle und aufschlussreiche Kommentare aus der ganzen Welt, die eine Bandbreite von Themen abdeckten, die Nutzern wichtig waren und somit von Bedeutung für die Wikimedia-Projekte sind. Dieses Feedback hat uns dabei geholfen, einen neuen Entwurf für die Datenschutzrichtlinie zu erstellen, der die Überlegungen der Community sowie jene der technischen Mitarbeiter und der Mitarbeiter der Rechtsabteilungen der Wikimedia Foundation widerspiegelt.
Aber unser Entwurf für die Datenschutzrichtlinie ist genau das: Ein Entwurf, der weiterer Kommentare aus der Community bedarf.   • Klare und unkomplizierte Formulierungen. Wir haben uns darum bemüht, diesen Entwurf in einer einfachen, eindeutigen Sprache zu verfassen, die jeder verstehen kann. Schließlich sind Datenschutzrichtlinien für die Nutzer bestimmt und nicht für Anwälte.
  • Keine Anforderung von und kein Erfordernis für Kontaktinformationen. Wir fragen euch nicht nach eurem Namen, eurer E-Mail oder eurer Anschrift, Telefonnummer oder ähnlichen Informationen als Voraussetzung für eine Mitarbeit an den oder eine Nutzung der Wikimedia-Projekte. Beiträge können anonym oder mit einem Konto bereitgestellt werden, und zur Einrichtung eines Standardkontos verlangen wir nur einen nicht personenbezogenen Benutzernamen und ein Passwort.
  • Beschränkung der erfassten Daten. Wir glauben, dass der beste Weg zum Schutz von Nutzerinformationen darin besteht, sie beim Nutzer zu belassen. Aus diesem Grund erfassen wir weniger Informationen als andere große Websites.
  • Nutzung eurer Informationen zur Verbesserung der Website. Wir erfassen Informationen nur, um zu verstehen, wie ihr die Websites benutzt und wie wir sie für euch verbessern können. Unsere Engineering-Teams verwenden Nutzerdaten dazu, bessere Websites zu entwickeln und euch relevantere Informationen zu liefern.
  • Kein Verkauf eurer Informationen. Wir werden eure Informationen unter keinen Umständen verkaufen. Die ganze Welt soll von eurem Wissen, aber niemand von euren Daten profitieren.
  • Maßnahmen zum Schutz eurer Daten. Wir ergreifen Vorsichtsmaßnahmen zum Schutz der Informationen, die wir haben. Wir setzen technische und physische Maßnahmen ein, um Nutzerdaten gegen eine ungewollte Offenlegung zu schützen. Außerdem ergreifen wir gegebenenfalls rechtliche Maßnahmen, um uns gegen eine Aufforderung zur Offenlegung von Nutzerdaten zur Wehr zu setzen.
  • Beschränkung der Aufbewahrung von Informationen auf den erforderlichen Zeitraum. Wir schützen Nutzer sowohl durch die Erfassung begrenzter Informationen als auch durch die Beschränkung des Aufbewahrungszeitraums auf das erforderliche Minimum. Wir bewahren die erhaltenen Informationen nur so lange auf, wie dies zur Erfüllung unserer internen Anforderungen und unserer gesetzlichen Verpflichtungen nötig ist.

Unser Engagement für den Schutz der Nutzerdaten ist nicht auf die Datenschutzrichtlinie beschränkt. Heute haben wir auch einen Entwurf der vorgeschlagenen Richtlinie für den Zugriff auf nicht öffentliche Informationen veröffentlicht. In diesem Richtlinienentwurf werden die Standards dafür festgelegt, wie Community-Mitglieder, die Zugang zu nicht öffentlichen Informationen haben, die ihnen zugänglich gemachten Daten nutzen bzw. nicht nutzen dürfen. Wie bei der Datenschutzrichtlinie möchten wir euch um Feedback zu diesem Dokument bitten, damit es die Werte der Community in diesem Kontext bestmöglich widerspiegelt.
In den kommenden Monaten werden wir auch Richtlinien zur Aufbewahrung von Daten, einen Transparenzbericht und ein Verfahren und Richtlinien für die Anforderung von Nutzerinformationen veröffentlichen. Die Richtlinien zur Aufbewahrung von Daten, die auf viele der Bedenken eingehen, die wir im anfänglichen Beratungszeitraum am meisten gehört haben, werden unsere Praktiken zur Datenerfassung und -aufbewahrung im Rahmen der neuen Datenschutzrichtlinie näher erklären. Der Transparenzbericht enthält Daten zur Anzahl und zum Ursprung der Anfragen bezüglich Nutzerinformationen, die wir erhalten. Weiterhin wird angegeben, wie oft wir solchen Anforderungen nachkommen. Wir wollen einfach wissen, wie wir diese Dokumente verbessern können. Wir werden eure Kommentare lesen und, genau wie bei den Nutzungsbedingungen, als Reaktion auf dieses Feedback entsprechende Änderungen einbeziehen. Diese Änderungen werden wir direkt auf der wiki vornehmen, damit ihr sehen könnt, wie die Richtlinien sich im Laufe des Zeitraums für Kommentare aus der Community und aufgrund eurer Vorschläge entwickeln. Nach Abschluss des Zeitraums für Kommentare und nachdem wir eure Empfehlungen durchgesehen und einbezogen haben, werden wir die Richtlinien dem Stiftungsrat der Wikimedia Foundation zur Überprüfung vorlegen.
Hier sei noch einmal erwähnt, dass der Abschluss des Zeitraums für Kommentare für den 15. Januar 2014 vorgesehen ist. Wir stellen eine Übersetzung des Entwurfs der Datenschutzrichtlinie und der Richtlinie für den Zugriff auf nicht öffentliche Informationen ins Arabische, Französische, Deutsche, Japanische und Spanische zur Verfügung. Wir wären den Community-Mitgliedern für ihre Unterstützung bei der Verbesserung dieser Übersetzungen, der Übersetzung dieser Entwürfe in weitere Sprachen und der Übersetzung des von anderen in diesem Beratungszeitraum abgegebenen Feedbacks dankbar. Eine internationale Beteiligung ist uns sehr wichtig, und falls mehr Zeit für Übersetzungen oder Kommentare erforderlich ist, werden wir dies beim Abschluss des Zeitraums für Kommentare berücksichtigen.
Diese Entwürfe repräsentieren die gemeinsamen Bemühungen der Wikimedia-Community extern und zahlreicher Abteilungen der Wikimedia Foundation intern. So you make an account and your username appears when making edits or submissions and according to the terms this can be FALSE or “NOT REAL” information, and there is no mention of displaying or any real specifics regarding the retention of the IP address used, if a user account is made. Could easily be “You do not explcicitly consent or understand your information being stored…processed…generally futzed with within the USA, however you do implicitly give permission for active perusal of said information by Wikimedia for development reasons. Please solve future ca.wikipedia.org scandal, where a few extreme nationalists are shamefully banning Spanish flag, substituting by the local flag in the region of Catalonia. In regard to privacy and anonymous users, it should be made very clear that posting an edit is actually less private than logging on to Wikipedia. At the same time, perhaps the trade off could be somehow requiring improved citation of sources. There are many legitimate reasons people in high levels of academia, entertainment, and other professional disciplines do not wish to reveal their location. I just think the whole idea of an organization such as yourselves collecting ANY user data for ANY reason is appalling. There is an expression ” The thin end of the wedge.” Which this may ultimately turn out to be. At this time you have expressed that there is now and forever will be no intention of selling this data. For those worried about disclosing their IP Address, take a lesson from the many peoples of the world who use anonamizer software, or use publicly available computers or free Wi-Fi Hotspots, as well as disabling those cookies & other features that you are uncomfortable with (Are users that disable those features identifiable & trackable? In my opinion Wikipedia (at least Wipipedia.it) is as talking at a brick wall. It’impossible to have infomations or discuss (no kidding, not with a a bunch of weaned or full of themselves people). I’ve found only o couple of helpful people. If you remove all contacts between the real people that “do” wikipedia, then it will became an exercise of solipsism. Wikipedia, sadly, has become a propaganda mouth piece for the status quo. Nothing of value or of importance is every allowed to be summarized honestly within Wikipedia. There is zero neutrality. While Wikipedia loves to have the image of “democratic input” and “neutrality” it simply isn’t the case – when the Wiki entries have gatekeepers that do not allow neutral or verifiable contradicting information that goes against the status quo. Please do NOT release any personal data without prior judicial approval. I don’t think Wikipedia is the kind of website against freedom of speech and freedom of thought. I think we should contribute and navigate Wikipedia without fear as long as we do not do anything ilegal. We do not live in a totalitarian state, do we? Thanks for your great job.

I think a privacy policy would be a great idea to keep what others are reading about safe to read and share with friends.
